RULES AND REGULATIONS — CAPITAL ONE CHARITY CONTEST
THE CONTEST AND THE CONTEST PERIOD
The Capital One Charity Contest (the "Contest") commences at 9:00:00 a.m. Eastern Time ("ET") on March 1, 2011 and concludes at 9:00:00 p.m. ET on March 31, 2011 (the "Contest Period").
ELIGIBILITY
The Contest is open to residents of British Columbia, Alberta, Saskatchewan, Manitoba, Ontario, Quebec, Nova Scotia, Newfoundland, New Brunswick and Prince Edward Island who have reached the age of majority in their province of residence, excluding employees, representatives, agents, directors and officers of Capital One and CanadaHelps and their affiliates, and their respective advertising and promotional agencies, as well as immediate family members of and persons domiciled with any of the foregoing. "Immediate family member" means parents, sisters, brothers, children and spouse.
HOW TO ENTER AND WIN
No purchase required: Each person that completes the online quiz on charity fraud at www.canadahelps.org during the Contest Period including providing their name and email address and provides the name of their preferred charity is automatically given one entry. The charity chosen must be a federally registered charity with the Canadian Revenue Agency in order for the entry to be eligible for the Contest.
DRAWING AND PRIZE
Weekly Prizes: There are four (4) weekly prizes ("Weekly Prizes") available to be won. A random draw will be held on March 8, 2011 of all eligible entries received during the period starting at 9:00:00 a.m. ET on March 1, 2011 and ending at 12:00:00 p.m. ET on March 7, 2011. A random draw will be held on March 15, 2011 of all eligible entries received during the period starting at 12:00:01 a.m. ET on March 8, 2011 and ending at 12:00 p.m. ET on March 14, 2011. A random draw will be held on March 22, 2011 of all eligible entries received during the period starting at 12:00:01 a.m. ET on March 15, 2011 and ending at 12:00:00 p.m. ET on March 21, 2011. A random draw will be held on April 1, 2011 of all eligible entries received during the period starting at 12:0:01 a.m. ET on March 22, 2011 and ending at 9:00:00 p.m. ET on March 31, 2011. The name drawn for each weekly draw will be the potential winner of the prize of a $1,000.00 donation to the charity provided in their entry.
Grand Prize: All eligible entries received during the Contest Period will be entered into a random draw to be held on April 1, 2011. There is one (1) grand prize "(Grand Prize") of a $20,000.00 donation to the charity provided in the entry available to be won. One (1) potential winner will be drawn at random from among all eligible entries.
All dollar amounts refer to Canadian dollars. Prize must be accepted as awarded and is non-transferable. Prize will be delivered to charity provided in the entry of the Contest winner.
LIMITATION ON NUMBER OF ENTRIES PERMITTED
Only one (1) entry per person is permitted. Multiple entries by the same person will be discarded and may result in disqualification at Capital One and CanadaHelps's sole discretion. Entries are subject to verification and will be declared invalid if they are illegible, reproduced, falsified, altered or tampered with in any way.
CHANCES OF WINNING
Chances of winning a Weekly Prize depend on the total number of eligible entries received during the eligibility period of each weekly draw period. Chances of winning the Grand Prize depend on the total number of eligible entries received during the Contest Period. Capital One's decisions will be final and binding in all respects on all entrants.
DECLARATION AND RELEASE OF PRIZE WINNER
Before being confirmed as the winner and awarded the prize the selected entrant must:
- Correctly answer, unaided, a time-limited skill-testing mathematical question;
- Sign a standard Declaration and Release form;
- Otherwise comply with the Contest Rules.
Selected entrant will be contacted at the email address that he/she provided. If the selected entrant does not respond within seven (7) business days following the day he/she was emailed, incorrectly answers the skill-testing question, declines the prize, or fails to return a Declaration and Release as specified by Capital One, Capital One reserves the right to select another entrant or to cancel the Prize.
SUBSTITUTION OR CHANGE TO CONTEST
Capital One reserves the right, subject in Quebec to the approval of the Regie des alcools, des courses et des jeux du Quebec, to change the Contest Rules or cancel, terminate, modify or withdraw the Contest at any time, without prior notice, for any purpose, including should a virus, bug or other cause beyond the control of Capital One corrupt or affect the administration, security, fairness or proper administration of the Contest.
OWNERSHIP OF ENTRIES
All entries shall become the property of Capital One and will not be acknowledged or returned.
RELEASE OF LIABILITY
Capital One, CanadaHelps, their affiliates, and all of their directors, officers, employees, agents, as well as their respective and promotional agencies (collectively, the "Releasees") assume no responsibility for late, lost, stolen, destroyed, illegible or otherwise indecipherable entries, for any failure or technical malfunction of any website, telephone networks, on-line computer systems of equipment, servers, access providers, or software, poor reception or technical problems, or for any failure of any email or submission to be received by Capital One or CanadaHelps on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof. The Releasees further assume no liability for any injury or damage to an entrant's or any other person's computer or other property related to or resulting from participation in this Contest or from accessing or downloading any material relating to the Contest.
CONSENT TO USE OF PERSONALITY
By entering the Contest the prize winner consents to the use of his or her name, city of residence, photograph, voice, likeness, image or any other aspect of his or her personality, for any publicity and programming purposes, commercial or otherwise, in all media used by Capital One and CanadaHelps, their affiliates, promoters and their advertising and promotional agencies, without territorial or time limitations and without additional payment or compensation.
CONSENT TO COLLECTION AND USE OF PERSONAL INFORMATION
By entering the Contest, and voluntarily providing personal information including, but not limited to, name and email address (the "Registrant Information"), each Contest entrant grants permission to Capital One and CanadaHelps and their affiliates to the collection and use of the Registrant Information for the purpose of administering the Contest and selecting the prize winner, and for any other purposes required or permitted by law.
COMPLIANCE WITH CONTEST RULES
All entrants agree to abide by the Contest Rules, which are subject to change at the sole discretion of Capital One, subject in Quebec to the approval of the Regie des alcools, des courses et des jeux du Quebec. Any attempt to deliberately damage or to undermine the legitimate operation of the Contest is a violation of criminal and civil laws, and should such an attempt be made, Capital One reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
FOR QUEBEC RESIDENTS ONLY
Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Regie des alcools, des courses et des jeux du Quebec for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Regie only for the purpose of helping the parties reach a settlement.
COMPLIANCE WITH LAWS
The Contest is void where prohibited by law and is subject to all applicable federal, provincial, and municipal laws and regulations.
