Post an “unselfie” photo telling us what charitable act you plan to do in honour of GivingTuesday using the hashtag #GivingTuesdayCA to the CanadaHelps Facebook page or Tweet to @CanadaHelps between November 22, 2016 and November 28, 2016 for a chance to win a $100 CanadaHelps gift card every day!

1. General

GivingTuesdayCA Unselfie Gift Card Draw (the “Contest”) begins November 22, 2016 at midnight Eastern Standard Time (EST) and ends on November 28, 2016 at 11:59:59 p.m. Eastern Standard Time (EST). The Contest is run by CanadaHelps Canadon (the “Sponsor”). For the purposes of the Contest, the “Contest Group” is composed of the Sponsor, including without limitation their parent, sister and subsidiary organizations, advertising and promotion agencies, suppliers of material and services related to the Contest, and any other corporation, partnership, sole proprietorship or other legal entity directly involved in the Contest and their respective officers, directors, employees, agents, and other representatives.

2. Eligibility

GivingTuesdayCA Unselfie Gift Card Draw (“Contest”) is open to all legal residents of Canada, other than the Province of Quebec, who have reached 18 years of age or (in the event that a winner is under 18 years of age, the prize will be awarded if the consent of his or her legal guardian is first given and obtained) the applicable age of majority in their jurisdiction as of the beginning of the Contest Period, and who are not an employee of or domiciled with an employee of the CanadaHelps, their advertising and promotional agencies or the contest judges. No purchase is necessary and only one entry is valid and permitted per day per entrant. The Contest is subject in all instances to compliance with applicable law.

3. How to Enter

The Contest is offered electronically via the Internet. Entrants must have a Facebook or Twitter account (each a “Social Network Account”) to enter the Contest. Entrants who do not have a Social Network Account can create one by visiting www.facebook.com or www.twitter.com and following the sign-up instructions.

To enter visit the CanadaHelps Facebook page (https://www.facebook.com/canadahelps), or Twitter account (@CanadaHelps), and post or tweet an original “Unselfie” photo of you, using the hashtag #GivingTuesdayCA before the Contest closing date and time. Upon doing so, and subject to the approval of the Sponsor, each Eligible Entrant will receive one (1) entry into the Contest up to a maximum of one entry per day for each unique photo submitted.

Limit of one (1) entry per person per day regardless of social media platform used to enter. For the purposes of this contest, an entry occurs when the contestant posts or tweets a photo and uses the hashtag #GivingTuesdayCA on the contest post.

Entrants must include the hashtag #GivingTuesdayCA with their photo submission, and comply with the photo format and content requirements set out below to be eligible. Entries must be received on or before 11:59 p.m. EST each day to be eligible to win that day’s daily prize. Anyone found to use multiple Social Network Accounts to enter the same photo will be ineligible. If an entrant posts a photo containing inappropriate content, the photo will be removed and he or she will be disqualified.

Proof of submission does not constitute proof of receipt. All entry information becomes the property of CanadaHelps and will not be returned. All eligible entries are subject to verification. CanadaHelps reserves the right, in its sole discretion, to require proof of identity and/or eligibility (in a form acceptable to CanadaHelps) to participate in this contest. Contestants must comply with Facebook or Twitter Terms of Use. CanadaHelps is not responsible for entries that are not completed due to difficulties with Facebook or Twitter or that are deleted for any reason by Facebook or Twitter or by one of its members. Posts with inappropriate content will be disqualified. The time of entry will be determined by the time post is received by CanadaHelps.

Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, or using any robot, script, macro, or other automated service, are not permitted and will void all that entrant’s entries and that entrant will be disqualified from the contest (in the sole discretion of CanadaHelps). In the event of a dispute the authorized account holder of the email address used to enter will be deemed the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Potential winner may be required to show proof of being the authorized account holder.

4. Photo Format and Content Requirements

Submitted photos must be the entrant’s original creation and not copied or reproduced in whole or in part from another work, never have been previously exhibited publicly or submitted in any other contest or promotion.

Submissions must not include:

  • Names, home addresses, phone numbers, personal information
  • Derogatory characterizations of any ethnic, racial, sexual or religious groups;
  • Cursing, vulgarity, sexually explicit content, or any other content that is or could be considered inappropriate, unsuitable or offensive, all as determined by CanadaHelps and/or the contest judges in their sole discretion.
  • Conduct or other activities in violation of these Rules
  • Any identifiable third party products and/or trademarks, brands or logos (other than those of CanadaHelps)

All photo submissions must comply with these official rules. By entering the contest, participants agree that they have read and understand the official rules, that they meet the contest eligibility requirements and that they agree to comply with and abide by the official Contest rules and the decisions of CanadaHelps and the Contest judges. As a condition of entering the Contest each entrant warrants and represents that the photo submission does not infringe, misappropriate, or violate any rights of any third party including, without limitation, copyrights, moral rights, trademarks, trade secret, or right of privacy or publicity, personality rights or other intellectual property or other rights of any person or entity, and will not give rise to any claims for payment whatsoever. They also warrant that they have obtained consent from everyone in the photo submission. If the submitted photo includes a Minor, parental or legal consent is required. CanadaHelps reserves the right to disqualify any submission that does not meet the requirements of these official Rules and Regulations or is unsuitable to be entered into the Contest for any reason whatsoever, as determined by CanadaHelps and/or the Contest judges in their sole discretion.

5. How to Win

Daily starting on November 23, 2016 and continuing until November 29, 2016 CanadaHelps will select an entry from the previous day at approximately 10:00 a.m. EST at 355 Adelaide Street West, Toronto, Ontario. Sponsors will randomly select one entry received during the previous day as eligible to win a prize (“Selected Entrant”). Odds of being selected as eligible to win a prize depends on the total number of eligible Entries received.

6. Prize Claim Conditions

Those Selected Entrants will be notified by CanadaHelps publicly on CanadaHelps’ Facebook and Twitter.

In order to be declared a winner, Selected Entrant must: (i) respond to notification of selection within three (3) business days of first attempt by Sponsors; (ii) correctly answer a time-limited mathematical skill-testing question to be administered by telephone or email at a mutually convenient time; (iii) sign and return to Sponsors within the stated time period a written declaration and release form, releasing the Contest Group from any liability in connection with this Contest or the use or misuse or possession of any prize (the “Release”); and, (iv) otherwise comply with these Official Contest Rules.

Return of any prize or winner notification as undeliverable, inability to reach Selected Entrant, failure of Selected Entrant to respond to notification by the deadline, failure to provide proof of eligibility (if requested), the Release, or other required documentation in a timely manner, failure to correctly answer the skill-testing question, or other non-compliance with these Official Contest Rules may result in disqualification, forfeiture of the prize and, at Sponsors’ sole discretion, selection of an alternate Selected Entrant for the forfeited prize in accordance with these Official Contest Rules, who will be subject to disqualification in the same manner.

7. Prizes

There are seven (7) CanadaHelps Charity Gift Card prizes available to be won, valued at $100.00 CAD each or $700.00 CAD in total.

Prize must be accepted as awarded and may not be substituted, transferred or redeemed for cash or otherwise. Sponsors reserve the right, at their sole discretion, to substitute a prize of greater or equivalent monetary value if a prize cannot be awarded as described for any reason. Sponsors will not replace any lost or stolen prizes. Any other taxes, costs or expenses associated with the prizes not specified herein will be the responsibility of selected winners.

8. Right to Void / Terminate / Suspend / Modify

Sponsors reserve the right to terminate, suspend or modify this Contest, in whole or in part, at any time and without notice or obligation if, in Sponsors’ sole discretion, any factor interferes with its proper conduct as contemplated by these Official Contest Rules. Without limiting the generality of the foregoing, if the Contest, or any part thereof, is not capable of running as planned for any reason, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, programming errors, or technical failures, which, in the sole discretion of Sponsors, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsors may, in their sole discretion, void any suspect entries and: (a) terminate the Contest, or any portion thereof; (b) modify or suspend the Contest, or any portion thereof, to address the impairment and then resume the Contest, or relevant portion, in a manner that best conforms to the spirit of these Official Contest Rules; and/or (c) award the Prizes from among the eligible, non-suspect entries received up to the time of the impairment in accordance with the winner selection criteria discussed above.

9. General Conditions

Winning a prize is contingent on fulfilling all the requirements set forth herein. Decisions of Sponsors and/or any independent contest judging organization will be final and binding on all matters pertaining to this Contest. Sponsors reserve the right to correct any typographical, printing, computer programming or operator errors. Sponsors’ failure to enforce any term of these Official Contest Rules shall not constitute a waiver of that provision. The invalidity or unenforceability of any provision of these Official Contest Rules shall not affect the validity or enforceability of any other provision. If any provision of the Official Contest Rules is determined to be invalid or otherwise unenforceable, then the Official Contest Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. Sponsors reserves the right at its sole discretion to disqualify any entrant who tampers or attempts to tamper with the entry process, the operation of the Contest and/or Contest Website, violates the Official Contest Rules, or acts with intent to annoy, abuse, threaten or harass any other person. WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS CONTEST OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SPONSORS RESERVE THE RIGHT TO PROSECUTE AND SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

10. Limitations of Liability and Releases

BY PARTICIPATING IN THIS CONTEST, ENTRANTS AGREE THAT THE CONTEST GROUP HAS NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES) TO PERSONS OR PROPERTY RESULTING FROM A PRIZE, INCLUDING THE ACCEPTANCE, POSSESSION, MISUSE OR USE OF THE PRIZE, OR THE MERCHANDISE FOR WHICH IT IS REDEEMED. FURTHER BY PARTICIPATING IN THIS CONTEST, ENTRANTS AGREE THAT CONTEST GROUP HAS NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES) TO PERSONS OR PROPERTY RESULTING FROM: A) ENTRY OR PARTICIPATION IN THIS CONTEST, INCLUDING ACCESS TO AND USE OF THE CONTEST WEBSITE, OR B) ANY CLAIMS BASED ON PERSONALITY OR PRIVACY RIGHTS, DEFAMATION OR MERCHANDISE DELIVERY.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, therefore such exclusions may not apply to you.

Without limiting the foregoing, the Contest Group shall not be responsible for: (a) any incomplete or inaccurate information that is caused by Contest Website users, or by any of the equipment or programming associated with or utilized in the Contest, or by any technical or human error which may occur in the processing of submissions in the Contest; (b) lost, interrupted, or unavailable network, server, service provider, on-line systems, telephone networks or telephone lines, or any other connections; (c) the theft, destruction, loss or unauthorized access to, or alteration of, entries; (d) any problems with, or malfunctions or failures of, telephone networks or lines, computers or computer on-line systems, servers or providers, computer equipment, software, viruses or bugs; (e) garbled transmissions or miscommunications; (f) failure of any e-mail to be received by or from the Contest judging organization or Sponsors for any reason, including but not limited to traffic congestion on the Internet or at any website or combination thereof or technical incompatibility; (g) damage to a user’s computer equipment (software or hardware) occasioned by participation or downloading of materials related to this Contest; (h) printing, distribution, programming or production errors, and any other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise; or (i) technical, pictorial, typographical or editorial errors or omissions contained herein.
